As more and more municipalities in Ocean County move toward banning the sale of recreational marijuana, township officials in Toms River recently introduced an ordinance that would outlaw selling and growing marijuana within town limits.

Since New Jersey Governor Phil Murphy’s election earlier this year, residents and lawmakers in New Jersey have engaged in an ongoing dialogue about marijuana legalization. If the new Governor fulfills on his promise to legalize recreational marijuana use, possession, and sale across New Jersey, the potential implications range from an increase in tax revenue and boost in the State’s economy, to more fatal car accidents and people driving under the influence of marijuana.

In Toms River, the Township Council introduced an ordinance last week that would prohibit marijuana cultivation and distribution within the township’s bounds. Thus far, six of the seven council members supported the ban on recreational weed. Medical marijuana sales would still be permitted.

This makes Toms River the largest municipality in Ocean County to make a move against marijuana legalization. Both Berkeley Township and Point Pleasant Beach have previously passed anti-marijuana ordinances, while Seaside Heights, Ocean Gate, and Lavallette  may soon follow.

Until anything changes with current New Jersey marijuana law, these ordinances outlaw conduct that is already illegal. New Jersey expressly prohibits the possession, use, or distribution of marijuana unless it occurs within the strict confines of the State’s medical marijuana program.
