Jackson Township Man Among 4 Arrested on Heroin Charges

Jackson NJ Heroin LawyersA Jackson Township man was among four who were recently arrested in connection with a drug investigation. According to officials from the New Jersey State Police, the defendants are now facing charges for numerous drug offenses, including possession of heroin and heroin distribution.

After an investigation conducted by detectives from the New Jersey State Police into heroin distribution activities in South Jersey, authorities arrived at a residence on Church Road in Howell Township with two search warrants: one for 34-year-old Jackson resident Darnell Williams, and the other for 50-year-old Howell resident Joseph Cottrell. When searching the home, investigators discovered two and half bricks of heroin, as well as drug paraphernalia. The street value of the heroin has been estimated at $800.

Upon arrival, they reportedly arrested Cottrell without incident, while Williams allegedly attempted to flee the scene in a vehicle driven by 41-year-old Howell resident Daniel O’Shea. Police pursued O’Shea, who was arrested without incident. Williams, on the other hand, is said to have attempted to flee from the car on foot. He was ultimately taken into custody at Red Roof Inn in Neptune Township, at which time police also arrested 32-year-old Howell resident Nyesa Richardson.

The four individuals arrested are now facing a vast array of criminal charges. Williams was charged with distribution of heroin, as well as eluding. O’Shea was charged with possession of heroin, possession of drug paraphernalia, and obstructing the adminstration of law (also known as “obstruction of justice” or simply “obstruction”). Cottrell was charged with possession of heroin, possession of prescription drugs, and possession of hypodermic needles. Richardson was also charged with obstruction.

Notably, Cottrell was arrested earlier in July by New Jersey State Police at a residence in Toms River. When the arrest occurred, officials recovered 27 bricks of heroin, with an estimated value of approximately $6,700, as well as cash and drug paraphernalia.

Heroin Charges in New Jersey

The defendants in this case are facing serious penalties in connection with these drug charges, among the most serious of which are those for heroin distribution. However, in New Jersey, possession of heroin in any amount is an indictable crime. According to the statute which governs possession of heroin and certain other controlled dangerous substances, N.J.S.A. 2C:35-10, possession of heroin is a third degree crime, punishable by between 3 and 5 years in New Jersey State Prison. Heroin distribution charges are more variable in terms of their grading, as the measured weight of heroin involved in the specific case determines the degree of the charges. In other words, the more heroin you are accused of selling or possessing with intent to distribute, the more severe the potential penalties become.

It is not surprising that in this case, prescription drug charges were also filed against one of the people arrested. In fact, New Jersey is seeing what has been called a “heroin epidemic,” as more and more people become hooked on prescription opioids like Oxycontin and Percocet, and then turn to heroin when their prescription runs out or they can no longer afford pricey prescription drugs.
