An nj.com story recently reported the arrest of a Lakewood man at the Ramada Inn on Route 9 in Toms River hotel. Officers responded to a disturbance in which the 23-year-old suspect threatened hotel employees who tried to kick him out. According to witnesses, the man was in a visibly intoxicated state during the events leading up to the arrest. A search incident to arrest yielded over $47,000 in cash, 170 wax folds of heroin, 11 hypodermic needles, and three glass pipes. As a result of the evidence and his behavior, the man faces possession of CDS, possession of heroin with intent to distribute, possession of hypodermic needles, and two counts of possession of drug paraphernalia.
The possession of more than five ounces of heroin with the intent to distribute is a first degree indictable offense that is punishable by ten to twenty years in state prison. Furthermore, the charge carries with it a presumption of incarceration. Possession of drug paraphernalia, on the other hand, is a disorderly persons offense punishable by fines and up to 6 months in county jail.
